Truck Accident Lawyers in Dallas and Paulding County

Paulding County has no interstate, and that is the whole of the trucking story here. Every heavy vehicle crossing the county does it on US-278 and on state routes 61, 120 and 92 — roads with at-grade intersections, private driveways, turning traffic and no median for much of their length. The nearest interstate ramp is I-20 exit 24, and it is outside the county entirely.

A commercial vehicle on a road like that is doing something an interstate was built to prevent. It is making left turns across oncoming traffic, stopping in a live lane to make a delivery, and passing through signalized intersections where the sight lines are set by tree lines and building frontages rather than by design standard. It is also sharing US-278 with the twenty-mile Paulding stretch of the Silver Comet Trail, which puts cyclists and pedestrians on the same corridor.

Paulding is the fastest-growing county in the north metro area at about 2.40 percent a year — a figure regularly and wrongly attributed to Cherokee — so the construction traffic is on top of the through traffic. Cases are filed at 280 Constitution Boulevard in Dallas, where Superior Court and State Court share a building and State Court sits in Room 1023, on a bench of three Superior Court judgeships reported at a workload value of 1.18. That is a strain measure for Superior Court only, published by the Administrative Office of the Courts, and it is not a processing time.

How we handle truck accidents

A trucking case is not a bigger car accident. There is a motor carrier, a driver, sometimes a broker and a shipper, and a set of federal regulations governing hours, maintenance, inspection and hiring that a passenger-car case has no equivalent for. There is also a spoliation clock: logs, telematics and dashcam footage are routinely overwritten within weeks. We send preservation letters the day we open a trucking file, and we treat the maintenance and hiring records as the case, not as background.
